Personal Data Protection

The Heeren MCST Personal Data Protection Policy (the “MCST’s Policy”) and the Chee Swee Cheng Group Personal Data Protection Policy (the “Managing Agent’s Policy”) apply to any Personal Data (as respectively defined in the MCST’s Policy and Managing Agent’s Policy) provided in this document (“Personal Data”). The Heeren MCST’s Managing Agent, Swee Cheng Management Pte Ltd, is part of the Chee Swee Cheng Group. The Heeren MCST and the Managing Agent require you to comply with Clause 10 of the MCST’s Policy and Clause 10 of the Managing Agent’s Policy, as the Third Party Source. Any Personal Data herein shall be collected, used and/or disclosed for the purposes notified below, the purposes notified in the MCST’s Policy and/or Managing Agent’s Policy, and/or in any circumstances permitted under the law: process, administer and/or manage the respective relationships of The Heeren MCST and the Managing Agent, with the Tenant in relation to the Building Mobile Access Pass.

Clause 10 of the MCST’s Policy

10. Personal Data from Third Party Source

10.1 This Clause 10 applies in respect of Personal Data about an individual which is obtained by The Heeren MCST from a source other than that individual (“Third Party Source”).

10.2 The Third Party Source hereby represents, undertakes and warrants to The Heeren MCST that:

1. for any Personal Data of individuals that the Third Party Source is or will be disclosing to The Heeren MCST, whether directly or through an intermediary, the Third Party Source would have, prior to disclosing such Personal Data to The Heeren MCST, obtained the appropriate consent from the individuals whose Personal Data are being disclosed, to:
   
   
1. permit the Third Party Source to collect, use and/or disclose the individuals’ Personal Data to The Heeren MCST for the Permitted Purposes and in accordance with this Policy; and
   
   
2. permit The Heeren MCST to collect, use and/or disclose the individuals’ Personal Data for the Permitted Purposes and in accordance with this Policy;
   
   
2. any Personal Data of individuals that the Third Party Source will be or is disclosing to The Heeren MCST is accurate and complete;
   
   
3. the Third Party Source shall give The Heeren MCST notice in writing addressed to The Heeren MCST Data Protection Officer at the contact particulars provided in Clause 14 below as soon as is reasonably practicable should it be aware that: (i) any such Personal Data has been updated or changed after such disclosure; and/or (ii) any individual above has withdrawn such consent as set out at sub-Clause (a); and
   
   
4. the Third Party Source shall otherwise assist The Heeren MCST to comply with the Act.
   
   

10.3 Notwithstanding anything to the contrary, the Third Party Source undertakes to indemnify and at all times hereafter to keep The Heeren MCST, together with their respective officers, employees and agents (each an “Injured Party”), indemnified against any and all losses, damages, actions, proceedings, costs, claims, demands, liabilities (including full legal costs on an indemnity basis) which may be suffered or incurred by the Injured Party or asserted against the Injured Party by any Organisation (including without limitation the Third Party Source and its agents) whatsoever, in respect of any matter or event whatsoever arising out of, in the course of, by reason of or in respect of: (i) any breach of any of the terms in this Clause; and/or (ii) any act or omission by the Third Party Source that causes The Heeren MCST to be in breach of the Act.
